On the day after the latest chapter in the Greek euro crisis, in July 2015, a group of African and European lawyers published an article, on the www.ohada.com website, urging the countries that use the Euro to take inspiration from the success of the OHADA reform and base the single European currency on a unified system of business law, which would be a vector for the economic, tax and social convergence that is essential for the very survival of the Euro (Read the article of 24 July 2015 ).

After the publication of a survey of European business law that was produced by fourteen leading academics and lawyers from the Henri Capitant Association, under the aegis of the Civil Law Initiative (Fondation pour le droit continental), with a preface by former French President Valéry Giscard d’Estaing, a major figure in the movement for European integration, and the distribution of a summary to the highest authorities in the EU and its larger Member States, the European Commission has now observed that there is a need to create a European Business Code (Read the summary and the preface of former French President Valéry Giscard d’Estaing).

Il giorno dopo l’ultima crisi greca dell’Euro, nel luglio 2015, un gruppo di giuristi africani ed europei aveva pubblicato sul sito www.ohada.com un appello affinché i paesi che condividono l’euro si ispirino al successo della riforma OHADA e addossino la moneta unica europea a un sistema di diritto commerciale unificato, che agisca da vettore della convergenza economica, fiscale e sociale indispensabile alla perennità stessa dell’Euro. A seguito della pubblicazione di un inventario del diritto europeo commerciale realizzato da quattordici eminenti giuristi dell’associazione Henri Capitant, sotto l’egida della Fondation pour le droit continental, il quale inventario è arricchito della prefazione del Presidente Valéry Giscard d’Estaing, illustre protagonista della costruzione europea, e della diffusione di una nota di sintesi alle più alte istanze dell’UE e dei suoi grandi Stati membri, la Commissione europea ha asserito la necessità di realizzare un Codice europeo degli affari (leggere la nota di sintesi et la prefazione del Presidente Valéry Giscard d’Estaing).

Afin de surmonter les difficultés auxquelles l’Union européenne fait face, il est indispensable de faire la preuve que le processus d’intégration est toujours dynamique et que l’Union est capable de répondre aux besoins de ses citoyens. Les compétences historiques des communautés, dans le marché intérieur, justifient une action dans le domaine des affaires¹ ; une harmonisation de ce domaine constitue la suite logique de la libéralisation du marché². En effet, il est difficile de créer un véritable espace économique sans appliquer des règles similaires³ à tous ses acteurs.

Dans le domaine des affaires, l’Union européenne s’est essentiellement concentrée sur la protection des consommateurs et, avec la crise financière, sur la réglementation des marchés financiers⁴.
